Testing the Limits: Field Sobriety and BAC Tests
If you are arrested for drunk driving, you will probably be asked to take two different types of tests. One is a test of your blood alcohol concentration (BAC). The other is a field sobriety test.

It is important to know that if you refuse to allow testing to determine the level of alcohol in your blood, your license will be revoked automatically for one year. You will not have the option of fighting the license suspension at an administrative hearing and you will not be able to obtain a provisional license to drive to and from work.
Do not confuse the results of a blood alcohol test with a guilty verdict. If you do take the blood alcohol test, we can attack the validity of the test and the test results in court. We may ask whether the officer was properly trained in administering the test or whether the testing device was properly calibrated, for example.
Field Sobriety Tests
Walking a straight line, standing on one foot and saying the alphabet backwards are all types of field sobriety tests. Police officers often base their decisions about whether or not a person is legally under the influence of drugs or alcohol on the results of these tests. The problem is that many field sobriety tests are simply not valid. Those that are require that the officer be properly trained in the administration of the test and evaluation of the results.
